A divorce agreement template is used to prepare own divorce agreement, and usually it is held between a married couple to break off the marriage completely with a divorce. This agreement basically concludes the wedding and that the two individuals are no longer bound to stay with each other by law. Additionally, it declares how the owned properties, joint savings, and current residence will be distributed. It clarifies each and every aspect so that both parties do not have to quarrel over any of their belongings. A divorce agreement can be made after the divorce has been filed or even before. It enables both parties to smoothly go through the divorcing process without having to go through any trouble regarding property and stuff. A divorce agreement is usually made by a professional like lawyer or in the presence of a lawyer to ensure that none of the distributions are unfair to either individual. To avoid this, both parties should individually hire a lawyer to review the agreement.
A divorce agreement consists of the following terms;
1- The first thing to include in this agreement is the date. The date on which the agreement will be made effective.
2- Basic introduction of both parties. This introduction includes their name, age, contact information, and current address.
3- Information about any child/children. Their name, age, and address.
4- Information about their marriage. For example, how long had they been married for? When did the divorce take place? And if the couple is already divorced?
5- Details about the responsibilities that each individual needs to take on, such as child custody, and child expenses.
6- The other matters that need to be addressed and dealt with, such as properties, joint accounts, savings, and current residence.
7- After discussing all these terms, the confidential information should be clarified. This means that which parts of this agreement can be disclosed to the public or friends, and which parts should remain strictly confidential.
8- It is important for the lawyer to clarify the law under which this agreement is being based off and the result of violation of this law. Such that each party acknowledges what will be the outcome of violating any of the terms mentioned in the agreement.
Both the parties are asked to verbally agree to all of these terms in the presence of the lawyers or attorneys. This process can even sometimes take place in the presence of the jury in the court room. Both individuals can receive copies of this agreement. This document can be used by each party as legal proof in case any of their rights get violated from the agreement. For example, the ex-husband does not give the ex-wife her part of the property. In such a case, she can contact her lawyer, show the agreement where it is written that she has equal rights in the property, and charge him of breaching her rights.
