Cohabitation Agreement Template

A cohabitation agreement template is a legal contract between two partners to live together in the same premises. The partners may be of the same gender or mostly the opposite gender. The purpose of this agreement is for both the partners to share, protect each others rights, and help each other out in case of any legal problems. This agreement is mostly carried out between a pair of couple that has been in a relationship for time period and want to move in together without getting married. This way the pair will be treated as one in a lot of scenarios such as child care, bills, and property. A cohabitation agreement template also illustrates what will happen if one of the partners dies or wants to move out of the apartment. In this case, they would have to sign a separation agreement. This agreement usually has a time duration till which it stays effective. After this time period, the couple has to renew the agreement in order to continue living together.

Elements of Cohabitation Agreement

This agreement should include all specifications for the agreement. All the terms should be mentioned clearly to avoid any confusions and misconceptions. It must include all possibilities that could arise in the future and how the pair will deal with them. Some of the common elements of a cohabitation element are as follows:

Date: The date on which the agreement will be made effective.

Introduction: The introduction to both parties as it includes their name, address, and contact information.

Purpose: The reason why both parties are coming together to hold this agreement. In this case, the parties are coming together to agree to certain terms and conditions in order to live together.

Terms: This is the most important and descriptive part of the agreement. It includes certain terms, conditions and rules that both parties have to abide to in order to start living together in the same premises. Now, all the terms mentioned in this part of the agreement must have the consent of both parties, or the agreement cannot be made effective. It includes the following terms:

The marital status of both parties must be specified. Whether they are married or un-married.

How will the finances of the business or organization can be managed? For example, the bills, rent, and property repairing. If both parties will contribute to such expenses and how much do they have to contribute.

In the case of children, which party is responsible for their expenses, such as educational, food, and other necessities.

Property rights must be clearly mentioned. In case of joint ownership, it must be cleared out what will happen to the property of the other party if they die or want to move out, or if any other reason arises.

The both parties must agree to consider each others right to privacy and other personal aspects. Such as loud noises, pet peeves, and allergies to pets.

Addition and subtraction to certain terms is appreciated. They can improvise the terms according to their requirement.

Signature: Lastly, both the parties are required to do their signatures to show that they have agreed to all the terms mentioned above in the agreement.
