Co-owner Agreement Template

A co-ownership agreement template plays a very crucial role between two parties to own a mutual ownership over some property or asset. According to this agreement, the property will have two owners and both of them will have equal rights and ownership over it. The agreement helps both parties understand the rules, responsibilities and rights of each party. Generally, a co-ownership agreement can be held between any number of parties, usually from two to three. The agreement also helps both understand the outcome of the death of either of the owners. In short, any possible outcome, casualty, problem, and benefit will be discussed in this agreement.

Importance of Co-owner Agreement

A co-ownership agreement template is composed of the definitions, purpose, amount details, and property details. It also tells that any monetary or other profit gained through the property will be distributed equally among both owners. Basically, all possibilities and important points that both the parties need to be aware of are written in a clear-cut manner. There are certain reasons to prepare a co-owner agreement; perhaps, the most significant is to make sure that there are minimal chances of disputes. However, there is a proper format in which everything is written.

Content of Co-owner Agreement

The contents of the agreement in their respective order are given below:

1. The date on which the agreement will be made effective.

2. The name of both owners, their company name, contact information and proper address.

3. The purpose of the agreement.

4. The definition and interpretation about the property. This includes all the details about the property or asset that will be co-owned. The parts of the property that will be owned by each owner will be specified.

5. The amount of money that is required by each party to buy the property. This amount depends on the number of co-owners in the agreement. The total price of the property is divided by the number of owners.

6. It is made clear who will be responsible for the maintenance and development of the property. In case of any damage, who will pay for it?

7. In case of loss or profit gained by the property, how will the money be divided?

8. Amount transaction details. How the money will be processed by each owner and which one of the owners will handle the finances of the property.

9. In case of death, or any other casualty of one of the owners, what will happen to their art of the property, who will become the heir of their party.

10. Confidentiality rights of both the owners must be mentioned clearly. This includes information about the contract that must not be disclosed to the public or any third party.

11. If one of the owner wants to sell his shares from the property, how will that be managed?

12. Lastly, how will disputes and arguments be dealt with in the future. This is an important point of the agreement because misunderstandings are inevitable. Hence, the methods to deal with them should be decided beforehand to avoid big clashes in the future. This also ensures a healthy co-ownership between both owners.
